Terms of use

Company - The Beauty Collective Ltd, Tiri Rd, Milford, North Shore City. These are the terms of use ("Terms of Use") for your use of services or features on the sites owned and controlled by The Beauty Collective Ltd including (www.thebeautycollective.co.nz)("Site"). We may add additional sites from time to time as we expand our beauty offerings and these Terms of Use will govern those new Sites when added. These Terms of Use govern your use of our Sites and your conduct, regardless of the means of access. We like to interact with you on third party sites where we post content or invite your feedback, such as www.facebook.com/thebeautycollectivenz, www.instagram.com/thebeautycollective ("Third Party Sites"). Our Terms of Use including services that involve Third Party Sites, but The Beauty Collective does not control those Third Party Sites, and these Terms of Use, do not apply to companies that The Beauty Collective does not own or control, or to the actions of people that The Beauty Collective does not employ or manage. You should always check the terms of use posted on Third Party Sites.

By accessing any sites containing or linking to our content, you signify your agreement to these Terms of Use, our Privacy Policy (available at The Beauty Collective) whether or not you have read them. If you do not agree with any of these, you must not use our Sites.

The Beauty Collective reserves the right to change or modify any of the terms and conditions contained in the Terms of Use, from time to time at any time, without notice, and in its sole discretion. If The Beauty Collective decides to change these Terms of Use, The Beauty Collective will post a new updated version on the Sites. It is your obligation to review these Terms of Use from time to time and if any provision or modification thereof is objectionable to you then you must immediately cease using the Sites. Your continued use of the Sites confirms your ongoing acceptance of these Terms of Use. Product Information

The products displayed on the Sites can be delivered to a physical address within New Zealand or Australia. All prices on the Sites are quoted in NZ $ dollars and include the current GST percentage.

All product statements / descriptions are intended to be used for personal education or informational purposes only. We do not intend or warrant that our products are or can be used to diagnose, treat, cure or prevent any condition or disease. All products should be used strictly in accordance with their instructions, precautions and guidelines. You should always check the ingredients for products to avoid potential allergic reactions. If you have any medical questions, concerns or need to make any decisions regarding possible treatment of any medical condition, then you must consult your physician or health care practitioner. The products available on the Sites and the Interactive Services, including any samples The Beauty Collective may provide to you, are for your personal use only. You may not sell or resell any products you purchase or otherwise receive from The Beauty Collective. The Beauty Collective reserves the right, with or without notice, to cancel or reduce the quantity of any order to be filled or products to be provided to you that may result in a violation by you of these Terms of Use, as determined by The Beauty Collective in its sole discretion.

Third party content and third party sites

The Beauty Collective may provide content of third parties ("Third Party Content") or links to Third Party Sites as a service to those interested in this information. The Beauty Collective does not monitor, approve or have any control over any Third Party Content or Third Party Sites and the inclusion of links to Third Party Content or Third Party Sites does not imply any association or relationship between The Beauty Collective and such third party. The Beauty Collective does not guarantee, endorse or adopt the accuracy or completeness of any Third Party Content or any Third Party Site. The Beauty Collective is not responsible for updating or reviewing Third Party Content or Third Party Sites. You use Third Party Content and Third Party Sites at your own risk. Third Party Content including comments from Third Party users submitted to The Beauty Collective through the Interactive Services, do not necessarily reflect the views of The Beauty Collective.

Reservation of rights

The Beauty Collective reserves the right, at any time, without notice and in its sole discretion, to terminate your license to use the interactive services and sites and to block or prevent your future access to and use of the interactive services and the sites. The Beauty Collective may access, preserve and disclose your account information and content if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to (i) comply with legal process; (ii) enforce these Terms of Use , (iii) respond to claims that any Content violates the rights of third parties, (iv) respond to your requests for customer service, or (v) protect the rights, property or personal safety of The Beauty Collective (and its employees), its users and the public.

The Beauty Collective is providing the sites, their contents and the interactive services on an "as is" basis and makes no representations or warranties of any kind, express or implied, with respect to the operation of the sites or interactive services, the information, content, materials or products, included on the sites or as part of the interactive services. To the fullest extent permitted by law, The Beauty Collective disclaims all such representations and warranties, including for example warranties of merchantability and fitness for a particular purpose. In addition, The Beauty Collective does not represent or warrant that the information accessible via the sites or the interactive services is accurate, complete or current. Price and availability information is subject to change without notice.

The Beauty Collective will not be liable for any damages of any kind arising out of or in connection with the use of the sites or the interactive services. This is a comprehensive limitation of liability that applies to all damages of any kind, including but not limited to direct, indirect, incidental, punitive or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

Fraud protection

When processing an order, we screen all received orders for fraud or other types of unauthorised or illegal activity. We reserve the right to refuse to process an order for whatsoever reason (at our sole discretion). If such is the case, we may reject your order or our customer service department may call you at the phone number you provided (or use your email address) to confirm your order. We also reserve the right to cancel any accounts or refuse to ship to certain addresses for whatsoever reason (at our sole discretion). We take these measures to protect our customers as well as ourselves from fraud or other unauthorised or illegal activity.

Order processing

We endeavour to process orders within 24 working hours of receipt.
New Zealand orders have an expected delivery window of 5-7 business days. 
Australia orders have an expected delivery window of 7-10 business days.

Processing and shipping time does not include weekends, and orders placed on Friday after 11am, New Zealand time, along with all Saturday and Sunday orders will be processed the following Monday.

We currently ship to New Zealand and Australia.

Delivery & handling

Business Days: Monday - Friday (excluding Public Holidays) from 9am to 5pm New Zealand time.

We shall aim to let you know if we expect that we are unable to meet our estimated delivery date but we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.

New Zealand - *Free shipping on all orders over $40.00 NZD, nationwide, alternatively a $6.50 flat shipping fee will be charged on orders under $40.00 NZD

Australia - *Free shipping on all orders over $100.00 NZD alternatively a $18.00 NZD flat shipping fee will be charged on orders under $100.00 NZD

We cannot deliver to PO Boxes.

Payment methods

The Beauty Collective accepts payment by DPS

  • For security reasons you're billing name and address must match that of the credit card used for payment.
  • All purchases require bank authorization prior to processing. Only authorized orders will be processed and shipped.
  • Any payment by credit card or debit card must be paid to and received by The Beauty Collective before the order to which such payment shall be accepted by The Beauty Collective and deliver thereof commenced.

Gst

The Beauty Collective is required by law to collect sales tax in the form of GST which is included in all our prices

Returns & exchanges

Please keep in mind that we are unable to exchange or refund stock if your colour choice is incorrect, please choose your colour option carefully, thank you.

The Beauty Collective would like you to be satisfied with your purchase. However, if you wish to return any products for any reason, you must apply in writing to The Beauty Collective (customer services) within 14 days from the date you receive such products. If you fail to seek consent to return the products within that period of time (time being of the essence) you will be conclusively deemed to have accepted the products and The Beauty Collective shall not incur any subsequent liability in respect thereof.

If The Beauty Collective gives its written consent for the return of the products, the products must be returned together with a credit claim which quotes: the The Beauty Collective invoice number, the date of delivery of the products, and the name of the customer services representative of The Beauty Collective who approved the return, and the reason for the return. If you comply with the foregoing, The Beauty Collective may, at its own discretion entirely:

  • Give a credit to you for the products which have been correctly returned in the same condition and packaging in which they were dispatched (subject to a charge for reasonable costs where products were ordered incorrectly); or
  • Subject to any express warranty given by The Beauty Collective, to provide replacement products. In the event that the above provisions are not strictly complied with, The Beauty Collective will return such products to you at your expense. We are unable to refund any freight charges, and for reasons of hygiene, cannot replace or refund goods if they have been opened or the seals have been broken, unless they are faulty. We do not exchange or refund goods for the reason of change of mind.

Colour on the internet

Please keep in mind that we are unable to exchange or refund stock if your colour choice is incorrect, please choose your colour option carefully, thank you.

The Beauty Collective wants you to enjoy the products you buy from us. Please keep in mind that colour monitors display colours differently, so if you have concerns about specific colours of makeup, please email our customer service. We'll get back to you right away with information to help you select the colour that is right for you.

Risk in products

Notwithstanding any other provision of these Terms of Use, or the law, risk in products shall pass from The Beauty Collective to you when the products leave our premises.

Warranties & guarantees

The Beauty Collective does not provide any guarantees or warranties in respect of its products EXCEPT as expressly confirmed in these Terms of Use.

Governing law

These Terms of Use shall be governed by and construed in all respects in accordance with the laws of New Zealand. If any provision hereof is held to be invalid or unenforceable, the invalidity or unenforceability shall be deemed eliminated or modified to the minimum possible extent to make the remainder of these Terms of Use enforceable.

Failure by The Beauty Collective to insist upon strict performance of these Terms of Use shall not be a waiver of any rights of The Beauty Collective on any subsequent occasion.

Promotion codes

  • The The Beauty Collective promotional codes are only available on The Beauty Collective for deliveries within New Zealand Only, a valid physical address must be used. Also all The Beauty Collective customer T&C's apply.
  • One voucher code per customer per purchase.
  • Not to be used in conjunction with any other offer or sale items, the exclusive voucher code cannot be exchanged for cash, voucher code can not be applied at a later date or if product is out of stock.
  • We take no liability if you have misplaced your voucher code.
  • Voucher code hold a validation date per each individual promotion
